
Marc Rubin said that he was picking out the perfect spot to propose to his future wife in front of Cinderella Castle at the Magic Kingdom, when the most important moment of his life was foiled by a Walt Disney World employee who insisted that he moved, Orlando Sentinel reported (via court documents).
Back in 2018, Rubin sued Walt Disney Parks and Resorts following the altercation in 2015. The lawsuit was filed in September 2018 and was dismissed voluntary in March last year.

At the time, the established Orlando-based newspaper reported that Rubin was seeking more than $15,000.
The Walt Disney World Cast Member involved had a different account of what happened in July 2015. The 24-year-old Cast Member told authorities that when she asked Rubin to move three feet back for the parade route, Rubin “screamed in her face and grabbed her.”
According to documents obtained by the Orlando Sentinel, the 57-year-old from New York pleaded no contest to disorderly conduct and was fined $100 plus court costs. When the lawsuit was initially reported about, Rubin declined to comment.
In the lawsuit, Rubin said he was falsely accused of battery. Rubin sued for negligence, arguing that Disney falsely accused him of grabbing the Cast Member’s shirt and alleged that Disney didn’t release a copy of surveillance video as proof that he didn’t touch the Cast Member.
Rubin also sued for false arrest or imprisonment. In an email to the Orlando Sentinel, a Disney spokeswoman said the following:
“The safety of the people who work in and visit our parks is very important to us. We will respond to the allegations as appropriate in court.”

Rubin said that when the Cast Member asked him to move, he asked for a “brief delay” for the rest of the group to return from the concession stand, according to the lawsuit. The Cast Member insisted that he left immediately and a “verbal altercation ensued,” even though Rubin said he never touched her, the lawsuit says.
According to an incident-related report from the Orange County Sheriff’s Office, the Cast Member said Rubin became “aggressive” and yelled that he wasn’t moving without his kids. She turned around and Rubin grabbed her to pull her toward him, the report said.
Subsequently, “Marc grabbed her shirt collar and threaten(ed) to punch her in the face,” according to the incident report. On her portable radio, she called her manager who rushed over. According to the report, the manager said Rubin was swearing and grabbed his arm.
Reportedly, the manager didn’t arrive in time to see Rubin grab the Cast Member but said he witnessed “Marc’s demeanour and arrogance,” the incident report stated. Rubin was escorted to the security office and was later arrested by the sheriff’s office.
