According to a recently filed lawsuit, a man says he got hit in the eye with “smoldering” fireworks debris from Magic Kingdom’s nighttime spectacular.

Fabricio Javier Sanchez Lopez is suing Disney for the incident which occurred on the 24th November, 2023.

Lopez “was attending the ‘Happily Ever After’ fireworks show when he was struck in the eye by smoldering fireworks debris falling from the sky, causing significant injuries,” according to the complaint filed on the 31st October, 2025.

Lopez accused Disney of not accounting for the wind and the weather to keep guests safe during the nighttime spectacular.

“These fireworks shows involved significant quantities of explosives and pyrotechnics, which constitute ultra-hazardous and/or inherently dangerous activities,” the complaint said.

According to Florida Politics’ Gabrielle Russon, Disney faced a similar lawsuit in 2024.

Nicole Ulfie filed a lawsuit after her 7-year-old daughter was hit in the eye by fireworks ember while standing near Cinderella Castle in March 2023. Ulfie’s lawsuit is still pending.

A judge denied Disney’s motion to dismiss the complaint earlier in March, saying in the ruling that “the issue of whether fireworks is ultra-hazardous is a fact-intensive question that is inappropriate for resolution on a motion to dismiss.”
